Terms of Service

These Terms of Service (the “Terms”) form a legally binding agreement between you (“you”, “User”, “Customer”) and VidGen (“VidGen”, “we”, “us”, “our”) and govern your access to and use of vidgen.pk and any associated AI video generation, AI avatar video, voice cloning, text-to-speech, dubbing, captioning, API or related services (together, the “Service”). By creating an account, accessing the Service, or otherwise indicating acceptance, you agree to these Terms in full. If you do not agree, you must not use the Service.
01.Acceptance of these Terms
By registering for an account, accessing, browsing, downloading, installing, or otherwise using the Service in any manner, you confirm that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, our Cookie Policy, and our Refund Policy, each of which is incorporated by reference. If you accept these Terms on behalf of an organisation, you represent that you have authority to bind that organisation, in which case “you” and “your” refer to that organisation.
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, whichever is greater, to use the Service. If you are below this age, you must not register for or use the Service in any form.
02.Description of the Service
VidGen provides an integrated cloud-based platform for the generation of synthetic media, including but not limited to:
- AI video generation from text prompts (text-to-video) and from images (image-to-video);
- AI avatar video generation, including talking-head video produced from user-supplied images;
- AI voice generation, including text-to-speech (TTS), voice cloning, voiceovers, dubbing and captioning, in 600+ languages and dialects;
- related tools for editing, scheduling, exporting, and managing the resulting media.
VidGen reserves the right to modify, suspend, expand, restrict, or discontinue any feature, capability, language, format, output limit, or component of the Service at any time, in our sole discretion, with or without notice. Specifications stated on marketing pages (including video lengths, language counts, resolutions, and clone limits) are aspirational guidance and may evolve.
03.Accounts, security and credentials
You are solely responsible for (i) maintaining the confidentiality of your account credentials, (ii) all activities that occur under your account whether or not authorised by you, and (iii) ensuring the information you provide during registration and afterwards is accurate, current and complete. You must notify us immediately at security@vidgen.pk of any unauthorised use of, or access to, your account.
VidGen may suspend, restrict, or terminate any account at any time, with or without prior notice and without liability, where we reasonably believe a violation of these Terms has occurred or where required by law.
04.Acceptable Use Policy
You agree that you will not use the Service to create, upload, transmit, store, distribute, publish or otherwise make available any content that:
- is unlawful, defamatory, fraudulent, threatening, harassing, hateful, sexually explicit, or otherwise objectionable under applicable law;
- infringes any patent, trademark, trade secret, copyright, right of publicity, right of privacy, moral right, or any other proprietary right of any party;
- depicts a real, identifiable individual (including their face, voice, likeness, or biometric identifiers) without that individual’s prior, freely-given, specific, informed and unambiguous written consent — including for the avoidance of doubt the use of any photograph or voice sample as the basis for an AI avatar or voice clone;
- creates so-called “deepfake” content, non-consensual intimate imagery, or content intended to mislead viewers as to the identity, statements, conduct or endorsement of any real person, public figure, brand, or institution;
- impersonates, or could reasonably be mistaken for, a real person, organisation, government agency, public official, or political candidate, in a manner intended to deceive;
- targets minors in any harmful manner, or depicts minors in any sexualised, violent, or otherwise inappropriate context;
- promotes, facilitates, or instructs in violence, terrorism, self-harm, illegal drugs, illegal firearms, or other unlawful activities;
- is used for the manipulation of elections, the spread of medical misinformation, or the deception of the public;
- infringes upon any export-control, sanctions, anti-money-laundering, or other applicable regulatory regime;
- introduces malware, scraping bots, denial-of-service tools, or otherwise attempts to disrupt, reverse-engineer, decompile, probe, or compromise the Service or its underlying infrastructure.
You alone are responsible for the content you submit, generate, share or distribute through the Service. VidGen is a neutral facilitator providing generative tools; the moral, legal and reputational consequences of generated content rest with you.
VidGen reserves the right, but assumes no obligation, to monitor, review, refuse, remove, restrict, watermark, or terminate access to any content or account that we believe, in our sole discretion, violates this Acceptable Use Policy or any law.
05.Required consents and rights to your inputs
You represent and warrant that, for every photograph, voice sample, script, image, audio file, video clip, or other input you provide to the Service (each, an “Input”), you either own the relevant rights or have obtained all necessary licences, consents, releases and permissions from every identifiable individual, rights-holder and third party, sufficient to permit VidGen to process that Input and produce the Output (defined below) without infringing any rights or laws of any kind.
You agree to indemnify and hold VidGen harmless from any claim arising out of an Input for which you did not hold the required rights or consents (see Section 13).
06.Intellectual property
VidGen Platform. The Service, including the platform, software, models, model weights, fine-tuning datasets, user interfaces, brand, name, logo, copy, designs, documentation, APIs and underlying infrastructure (the “VidGen Platform”) is and will remain the exclusive property of VidGen and its licensors. Nothing in these Terms transfers ownership of the VidGen Platform to you. You are granted a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service strictly in accordance with these Terms.
Your Inputs. You retain all right, title and interest in and to your Inputs. You grant VidGen a worldwide, royalty-free, non-exclusive, sub-licensable licence to host, copy, transmit, process, transform, create derivatives of, display and otherwise use your Inputs solely as required to operate, maintain, secure, and improve the Service for you. We do not use your Inputs to train foundation models for other customers.
Outputs. Subject to your full compliance with these Terms and payment in full of all applicable fees, you own the audio, video and image files generated for you by the Service (the “Outputs”) to the extent permitted by applicable law. You acknowledge that, due to the nature of generative systems, similar or identical Outputs may be produced for other users from similar Inputs, and accordingly VidGen makes no representation that the Outputs are unique, novel, or eligible for copyright protection in any jurisdiction. You are solely responsible for assessing the legal status, suitability for use, and any required disclosures, watermarking, or labelling of the Outputs.
Trademarks. “VidGen” and the VidGen logo are trademarks of VidGen. You may not use them without our prior written consent except for fair, factual, descriptive reference to the Service.
07.Fees, credits, billing and taxes
The Service is offered on free and paid tiers. Paid tiers consume credits at the rates published on the pricing page and within the application. Credits are deducted as Service operations are performed and, except where expressly stated, are non-refundable, non-transferable, and expire as specified in your plan. Unused credits typically expire 30 days after their grant; renewal grants new credits.
By providing payment details, you authorise VidGen and its payment processors to charge the applicable amounts to your payment method on a recurring basis, including taxes, processing fees and duties where applicable. You are responsible for keeping payment details current. Failed payments may result in suspension of the Service.
Prices are exclusive of VAT, GST, withholding tax, and any other applicable taxes, which you are responsible for. Prices may be adjusted at any time on prospective notice; renewal cycles will reflect the prices in effect at the time of renewal.
08.Refunds
The Refund Policy is set out in the dedicated Refund Policy and forms part of these Terms by reference. In summary, consumed credits are non-refundable; eligible refund requests must be submitted within seven (7) calendar days of the original transaction; and refunds are issued at VidGen’s sole and reasonable discretion.
09.Third-party services
The Service may integrate with or rely on third-party providers (for example, cloud hosting, payment processors, content delivery networks). VidGen is not responsible for the acts, omissions, terms, performance, or availability of any third-party service. Your use of any such service is governed by the applicable third-party terms.
10.Beta features and changes
We may make experimental, beta, preview, or pre-release features available from time to time. Such features are provided “as is” for your convenience, may be unstable, may be modified or removed without notice, and are not subject to any service-level commitments. Use them at your own risk.
11.Disclaimer of warranties
To the maximum extent permitted by applicable law, the Service, the Outputs and all materials are provided “as is” and “as available”, with all faults and without warranty of any kind, whether express, implied, statutory, or otherwise. VidGen specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, quiet enjoyment, system integration, freedom from defects, freedom from harmful components, or arising from course of dealing or usage of trade.
VidGen does not warrant that the Service or Outputs will be uninterrupted, secure, error-free, free of viruses or other harmful components, accurate, reliable, or that any defects will be corrected. You use the Service and rely on Outputs entirely at your own risk.
12.Limitation of liability
To the maximum extent permitted by applicable law, in no event shall VidGen, its founders, directors, officers, employees, contractors, agents, suppliers or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages of any kind, including but not limited to lost profits, lost revenues, lost business opportunities, lost goodwill, lost data, business interruption, regulatory fines, reputational harm, or substitute service costs, arising out of or in any way connected with these Terms or your use of (or inability to use) the Service or Outputs, whether based on contract, tort (including negligence), strict liability, statute, indemnity or any other legal theory, and whether or not VidGen has been advised of the possibility of such damages.
VidGen’s total aggregate liability for any and all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount actually paid by you to VidGen in the three (3) months immediately preceding the event giving rise to the claim, or (b) one thousand Pakistani Rupees (Rs. 1,000). The existence of one or more claims will not enlarge this limit. Multiple claims do not enlarge this limit.
Some jurisdictions do not allow the limitation or exclusion of certain warranties or liabilities, and accordingly some of the above limitations may not apply to you in their entirety. In those jurisdictions VidGen’s liability shall be limited to the smallest extent permitted by law.
13.Indemnification
You agree to defend, indemnify and hold harmless VidGen, its founders, directors, officers, employees, contractors and agents from and against any and all claims, demands, actions, proceedings, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to (i) your Inputs; (ii) your Outputs; (iii) your use of the Service; (iv) your violation of these Terms or the Acceptable Use Policy; (v) your violation of any law or any third-party right (including any privacy, publicity or intellectual-property right); or (vi) any consent or right you represented you had but did not, in fact, have.
14.Suspension and termination
You may stop using the Service and close your account at any time. We may suspend, restrict, or terminate your account or access to the Service at any time, with or without notice, for any reason or no reason, including without limitation where we believe you have violated these Terms, where required by law, or where continued provision of the Service is no longer commercially reasonable. Sections that by their nature should survive (including IP, indemnity, liability, governing law and dispute resolution) survive termination.
15.Changes to the Service or to these Terms
We may modify these Terms at any time by posting an updated version on this page and updating the “Last updated” date above. Material changes will be brought to your attention through reasonable means (for example, by email or in-product notice). Your continued use of the Service following any such modification constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service.
16.Governing law and dispute resolution
These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them, their subject matter or formation, are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-laws principles. The parties irrevocably submit to the exclusive jurisdiction of the competent courts of Karachi, Pakistan to settle any dispute or claim arising out of or in connection with these Terms.
Notwithstanding the foregoing, VidGen may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.
17.Miscellaneous
Entire agreement. These Terms, together with the documents they reference, constitute the entire agreement between you and VidGen and supersede any prior agreements on the same subject.
Severability. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.
Waiver. Failure by VidGen to enforce any right or provision shall not constitute a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms freely.
Force majeure. Neither party shall be liable for any failure or delay caused by events beyond its reasonable control, including acts of god, war, terrorism, civil unrest, government action, network or power failure, pandemic, or natural disaster.
Notices. Notices to VidGen must be sent to legal@vidgen.pk. Notices to you may be delivered to the email address on file or posted in-product.
